交通事故 やらねばならない2つの義務 交通事故を起こした瞬間、何をすれば良いかなかなか冷静になれませんよね。ただ最低限やらなければならないことは2つはあります。まず1つは負傷者の救護（救護義務があります）です。救急車を呼ぶために119番通報して救護隊の方に事情を説明したリ負傷者が病院で適切な治療を受けられるように努力するのです。救護隊の方も事情がわかるだけで適切な医療行為ができるかどうかの判断ができます。 応急手当をする必要もある場合があります。例えば心肺停止なら人工呼吸や心臓が正常に拍動できない心停止状態のときに電気ショックを行って正常な心拍リズムをとり戻すためのAED（自動体外式除細動器）を行ったりします。自動車免許を取得した人は、必ず自動車教習所で応急手当法のことも勉強しているはずなので、イザ事故になってしまったという時は覚悟を決めてやらなければいけません。最悪なのは負傷者を放置して逃走することです。これだけは絶対にやってはいけません。後から重い罪を課せられてしまう場合があります。 もう1つのやらなければいけないことは、警察への報告（報告義務）です。事故を起こした後、負傷者の救急の活動が終わったら、すみやかに警察に届ける必要があります。どんなに小さな事故であったとしても、警察に届けなければいけません。また、もし怪我を負っていた場合は、その時は平気でなんともないようでも、１週間後などから痛みがでて後遺症（後遺障害）が残る場合もあります。警察に事故届けをしていないと場合によっては保険金の請求ができなくなってしまうこともあります。 ちなみに、この救護義務と報告義務を怠ると、道路交通法違反になってしまいます。この他にも交通事故を起こしたらやっておかねばならないことがあります。たとえば危険防止の措置です。後続事故を防ぐために他の通行車両の誘導などをしなければいけません。ただし事故車両の移動は、証拠の保存という意味から警察の検分が済むまでは動かさない方がいい場合もあります。それから保険会社への連絡もしておく必要があります。被害者側では加害者との示談交渉がありますので特に怪我をしている場合は山口県内の交通事故弁護士山口に相談しておくことも大切です。 交通事故 加害者が複数の場合の損害賠償請求 交通事故の被害にあった場合、相手に非があれば損害賠償を請求することが可能です。交通事故には、いろいろなパターンが存在します。一般的な交通事故の場合、どのように請求すれば良いのか迷うことは少ないです。しかし珍しいシチュエーションの場合、損害賠償請求について分からないこともあるのではないでしょうか。たとえば、加害者が複数存在する交通事故などもあります。今回はそのケースについて解説します。 比較的多いのは、交通違反をしている複数の自動車が接触事故を起こす交通事故です。それに巻き込まれてしまった場合、加害者は複数いることになります。また知人に乗車させてもらっているときに、知人が交通違反をして他の交通違反の自動車と事故を起こしてしまう例もあります。それによって自分が怪我をした場合、知人と相手が加害者です。もちろんこれらの場合でも、自分に過失があれば、一方的に他の人が加害者ということにはなりません。 ここで気になるのは、誰にどれぐらいの割合で請求すれば良いという事ではないでしょうか。たとえば加害者たちの責任の割合が同じだった場合、全員に同じ金額を請求しなければならないと感じる人もいるでしょう。しかし自分に過失がない場合、全員にでも1人にでも請求できるのです。交通事故で被った損害が150万円だった場合、3人の加害者に対して50万円ずつ請求する必要は必ずしもないということです。選んだ人数に請求できるということを覚えておいてください。1人に150万円ずつ請求しても構いませんし、2人に75万円ずつ請求しても問題ありません。ただし生じた損害以上の金額を請求することができません。人数は自由ですが、その合計は150万円以下でなければならないのです。
